LumiGleam operates this website and store (the “Services”), including all content, features, tools, products, and services available through it. LumiGleam is powered by Shopify, which enables us to provide these Services to you.

1. Eligibility & Account

  • You must be 18 years or older to use the Services. By using them, you confirm that you meet this requirement or are using the Services under the supervision of a parent or legal guardian.

5. Shipping & Risk of Loss

  • Shipping times are estimated and not guaranteed.

  • Title and risk of loss transfer to the customer once the item is handed to the shipping carrier.

  • California Compliance: Under Civil Code §1723, if we are unable to ship within 30 days, we will notify you and allow you to cancel for a full refund.

6. Returns & Refunds

  • Please refer to our detailed [Refund Policy], effective July 25, 2025.

  • We offer returns within 15 days of delivery for items that are defective, damaged, or not as described.

  • Contact must be made within 7 days of delivery, and you must include proof of purchase and photo evidence.

  • We do not refund for buyer’s remorse, incorrect shipping addresses, or unauthorized returns.

  • Under California Civil Code §1723, your rights to return apply to defective or misrepresented items only. This law is not waived by these Terms.

7. Intellectual Property

  • All content (text, logos, designs, images, etc.) is the exclusive property of LumiGleam or our licensors and protected by U.S. copyright and trademark law.

  • You may not copy, modify, reproduce, or sell any content without express permission.

8. Third-Party Services & Tools

  • Our Services may include tools or apps provided by third parties (e.g., Shopify apps).

  • We are not responsible for third-party privacy, performance, or content. Use at your own risk.

9. Shopify Relationship

  • LumiGleam operates independently on Shopify’s platform.

  • Shopify is not responsible for our store’s customer service, products, refunds, or policies.

10. Privacy & Data Use

  • We comply with the California Consumer Privacy Act (CCPA) and CalOPPA.

11. Prohibited Conduct

Sections covering intellectual property, disclaimers, liability, and dispute resolution will survive termination.

16. Dispute Resolution & Governing Law

  • These Terms are governed by the laws of the State of California.

  • Any disputes will be handled exclusively in the state or federal courts of Yuba County, California.
